4/01/2007 - More from Mike Fairburn on Club Law & Disciplinary Procedures.

8/1/2007 - Note from Bert Wilkinson.

I reply to those who have replied to my original message on Bowlers Forum and apologise for late reply (UK). When any sporting club opens in Spain it has to send to the Sporting authorities its constitution without which the club could not even be built. There is a standard constitution which normally satisfies the authorities but this still has to be registered and believe me it covers everything from how the AGM should be carried out to disciplinary measures which as these seem to concern most people I will try to explain further. What I wrote earlier is without doubt under Spanish constitutional matters regarding sporting clubs (remember includes bowling) the only way that disciplinary matters can be carried out. Try to remember that your clubs constitution may bear no resemblance whatsoever to what various committees try to foist on their members. As the Indalo is owned by all its members there were a large number of members who wanted to know exactly what their constitution said and so at a reasonably small cost this was translated into English and given to the members. It was only then that all the members became aware of their rights under Spanish law. As regards serving a denuncia on the club I would personally have no qualms about doing it if I felt genuinely aggrieved. However if you felt this would be taking matters too far, a letter to the Sports Council, (details of which should be known to your Federation Rep), outlining your grievance, should suffice, but they could insist on a denuncia first. Finally, there are too many overbearing committees who take the law into their own hands and dish out unlawful penalties. Before anyone thinks I am speaking personally, I am not, but I have taken part on a very few decisions at my own club, the harshest punishment of which has been a caution.

Hope this helps,

Yours Mike Fairburn, Indalo Bowling Club.
